General conditions of sale and legal information

1. Terms and conditions applicable to the web site www.leszarsouilles.com of the Sprl The Z'arsouilles, having its head office street of 600 Franchimontois 26, 4910 Theux

These terms and conditions are applicable to all transactions in the past in line with the sprl The Z'arsouilles. All contracts are governed and interpreted according to the Belgian law and any dispute between us is within the exclusive jurisdiction of the Courts of Liege in Belgium. Nothing in these terms and conditions will not be deemed to affect your statutory rights.

By the use of this site, you accept these terms and conditions, and all transactions with the sprl The Z'arsouilles are governed by these same terms and conditions.

Any reference to "Customer" refers to the person or persons who purchase or undertake to buy property to the corporation. Any reference to the Internet site includes a reference to all the urls belonging to the sprl The Z'arsouilles.

Any reference to the "Company" or to "we" means a reference to the sprl The Z'arsouilles

2. Prices

All prices are shown in Euros and include VAT at the current rate, unless otherwise clear and precise. The offers and the prices charged by the Sprl The Z'arsouilles are valid as long as they are displayed and within the limit of stocks available. All prices can be modified without prior notice.

 

3. Process of order and payment

The process of command on the site of the Z'arsouilles is as follows:

You select the items you want to order, and you add to your cart. On the Cart page, then you can click on the button "Proceed to the command". In order to continue your command, you must identify you or create an account.

Your contact information will be requested in order to carry out the processing of your order.

You can choose your mode of delivery among those proposed by filling in the required information. You will be informed before the final validation of your order, all delivery charges applicable to your order, if applicable. Your order will be valid only when you have provided this information, read and accepted the general terms and conditions of sale and process with success to the payment of your order by clicking on the control button accompanied by the mention "pay", this via the system of payment of our claimant Worldline. The payment process is fully secure. The command can be modified at any time before the final validation.

Once the payment is made, you can print the details of your order and follow its status on your personal account. An acknowledgment of receipt will be sent to you automatically by mail, containing the details of your order. The acknowledgment of receipt does not represent an acceptance of our share of your command: the acknowledgment of receipt you only confirms that we have received your order.

A mail of confirmation of shipment of products, containing the link monitoring of delivery, you will then be sent. The delivery of the products is true for acceptance of our share of your command. The delivery will be carried out only after the receipt of the payment of the order.

We reserve the right to refuse your order, in the following circumstances:

- the products are unavailable or exhausted;

- the products are the subject of a presentation erroneous and not valid in the E-shop;

- serious doubts of abuse of right or of bad faith on the part of the Client occur;

- a case of force majeure occurs.

 

In the case where we do not carry out the order, the customer will be informed at the earliest.

In the event of payment of the transaction with a credit or debit card, your order is complete and the contract between us is final only when we get the agreement of the issuer of the card. We accept Visa, MasterCard and Maestro (Bancontact). We cannot be held responsible for delays in the delivery and/or the absence of delivery of your order which would be of the refusal of the issuer of your card to make your payment. The commands that are not accompanied by a valid payment on behalf of the holder of the card are not accepted or processed.

To be able to place an order, you must be at least 18 years of age. If you are not 18 years of age, please move the order by your parent or legal guardian. We are in the right to refuse any command which we find that it is passed by a minor.

 

4. Delivery

All goods and services are delivered to the address that you specify when the command. In the case where the address that you have specified is invalid, it will be your responsibility and may result in additional costs to your load.

Outside of the withdrawal in store who is free, here are the modes of delivery possible:

- For Belgium: Via bpost at home or to a specific address, or in a point of withdrawal bpost

- For France , Luxembourg and the Netherlands: Via bpost for a delivery at home or to a specific address, or in a relay point via DPD Parcelshop ()

At the time of the order procedure, you will be informed of the possible cost of shipment. These are calculated definitively at the end of the ordering process, before the payment step.

The risks borne you will be transferred when the actual delivery of the product to the address that you have indicated. From this moment, we disclaim any liability in case of loss or destruction of the product.

The products are delivered, to the extent possible, within a period of 2 to 10 working days after the validation of the command. In the case where we would be unable to deliver within this time, we will inform you as soon as possible. In no case, a possible delay will not give rise to a compensation. In the exceptional case where we are unable to deliver the command in the 30 days from the date of the validation of the command, you can terminate the contract of sale by contacting our customer service. The products ordered will be reimbursed in full (including the expenses of sending in the case where you have supported) within a period of 30 days.

You have 7 days to remove your package in a point relay (Parcelshop). Past this time, the package we will automatically return. In this case, it will need to be again to pay the costs of the port as well as additional administrative costs of 10€.

You must ensure yourself that the products are suitable to your needs and are consistent with your expectations. We do not guarantee that the products conform to your individual requirements. The products are standard and are not designed to measure. For any dispute, you can contact our customer service.

In the case where the products are damaged during transport or that the products delivered various of the ordered products, you are required to inform us as quickly as possible and in all cases within 3 days, by contacting our customer service.

We disclaim all responsibility for any indirect damage caused by the late delivery or the absence of delivery by the carriers. In this case, our liability is limited to the value of the articles which it is proved that they have not been received by the customer.

Withdrawal In store: You can also remove free of charge your products to the store the Z'arsouilles. These will be reserved in your name during 7 working days from the time they are put aside in our store.

Our shipments are always made at our risk. You should therefore not worry if goods are lost during their postal consignment. In contrast, if you return to US property in the 14 days following the purchase, because you do not want to keep them, it is you who are responsible for their transport.

If the goods delivered by our care are damaged during transportation, that they do not correspond to the items mentioned on the delivery or do not correspond to the articles that you have ordered, you are required to report as quickly as possible and in all cases within 3 days, as well as we return the articles in the 10 calendar days following their receipt.

 

5. Returns and Exchanges

If you want to however we return your purchase, we offer you 2 ways to return: 

1. In Store 

On presentation of the purchase order, customer returns for free article in our store. He may choose to do an exchange, receive a good to argue.

In any case, the articles must be returned in their State of origin, fitted with their labels and in their original packaging, within a period of 15 days from the date of the date of delivery.

2. Via the transportation company

In the case of a return via the transportation company, the expenses of return will be at your charge. Exchange an article is only possible in our store.

6. Products

except an indication to the contrary, the products are sold to the unit and are not always available. In the case where one or several article(s) are unavailable at the time of the completion of the command, it we will unfortunately be unable to honor the order completely.

The sprl The Z'arsouilles ensures the intact state of the product when its delivery and its conformity to the information of the manufacturer. The use of the product must be followed according to the instructions issued by the manufacturer, described in the description of the product. You must ensure that you use the product in accordance with these instructions. 

We are working to deliver to you of the products in a perfect condition. However, if you report that the product is defective, you agree to keep the product in its current state so that we can examine in a reasonable period of time. We can require your assistance as well as certain information relating to the product, including details as to the manner in which the product is assumed to be damaged or defective and the sending of the delivery order completed and other necessary information, this in order to make a quick solution for the defective product.

7. Compliance and Guarantee

As far as this is possible and reasonable, you have the choice between repair or replacement. You have the right to require a reduction of the price or the resolution of the contract of sale if the repair or replacement is excessive or impossible, or if it cannot intervene in a reasonable period of time.

Any default or vice which is manifested in the 6 months that follow the delivery is deemed to have existed before the delivery, unless we are able to prove the contrary. Beyond 6 months, it is to you that it will be up to prove that the defect existed before the delivery.

 

8. Force Majeure

we cannot be held responsible for the non-respect of our obligations caused by or resulting from conflicts of labor or any other circumstance beyond the reasonable control of the company, such as fortuitous event, riots, popular movements, floods, fires, strikes, lock-out, the difficulty to obtain a means of transport or a legislation. If the one or the other of these circumstances prevents the company to deliver within a reasonable period of time the whole or a part of the ordered articles, the responsibility of the client is limited to the value of the articles provided and the costs of delivery which are associated with it.

 

9. Content

Any information displayed on our or our Internet sites or other printed by the company is not regarded as authoritative or certified as being the best practice and is to consider that as a useful information complementary to other codes of good practice certified. All the information on our Internet site are regularly updated.

 

10. Pricing errors and print

11. Ownership of Property

13. Complaints

Any complaint or a compliment, can be sent to our customer service (Info@leszarsouilles.be). We will endeavor to process your claim within 10 working days of its receipt. In the case where we could not bring immediate solution to your claim, we will notify you of the time likely to be needed to resolve the problem and we will keep you informed of any investigation.
